The short answer
Media liability may address covered defamation, privacy and specified intellectual-property allegations. It can appear within Tech E&O or a separate policy, but the insured activities and exclusions differ. A general liability advertising provision is not automatically equivalent. The premium examples below are illustrative, not carrier offers.
Use this guide to prepare questions, not to establish coverage. Any unsourced costs, limits or timing ranges are illustrative planning examples, not quotes, verified market averages or carrier commitments.
What media liability covers
| Claim | Example |
|---|---|
| Copyright infringement | Your marketing video uses unlicensed music |
| Trademark infringement | Your product name conflicts with a registered mark |
| Defamation | A published review harms a company’s reputation |
| Invasion of privacy | Content uses someone’s likeness without consent |
| Plagiarism and idea misappropriation | A claimant says you took their pitched concept |
What media liability usually excludes
- Patent infringement
- Trade secret misappropriation, on many policies
- Content published before the retroactive date
- Deliberate infringement once proven
- Liability taken on only by contract
Media liability inside Tech E&O, or standalone
Most Tech E&O policies include media and IP coverage for your software, website and marketing; see Tech E&O coverage for startups. StartupInsurance.ai can check your Tech E&O wording for media coverage. A standalone policy makes sense when you publish content at scale, host user content or run an ad business; see media liability for user content and ads. Terms are defined in the startup insurance glossary.

Frequently asked questions
Does media liability cover trade secret claims?
Often not. Many policies exclude trade secret misappropriation, and others limit it. If you hire from competitors or license others' technology, check the wording.
Do podcasts and webinars need media liability?
If they're occasional marketing, Tech E&O or general liability may respond. If content is a regular product or revenue line, a media policy gives a dedicated limit.
What is a prior publication exclusion?
It excludes claims over content first published before the policy's retroactive date. Keep coverage continuous so older content stays covered.
Does media liability cover patent infringement?
No. Patent claims are excluded from media and Tech E&O policies. Separate IP infringement defense insurance exists but is specialized and priced accordingly.
Is media liability claims-made?
Usually, yes, like Tech E&O. Claims must be made during the policy period, so avoid gaps and keep your retroactive date when switching carriers.
General information, not a coverage determination or legal advice. Unless a specific source is identified, prices and timing ranges are illustrative planning examples—not measured market averages, quotes or guarantees. Policy wording, carrier, state and your company’s operations determine what applies.
